Terms and Conditions for BirthdayBot Affiliate Marketing/Referral Program

Welcome to the BirthdayBot Referral Program (the "Program"). By participating in the Program, you agree to the following Terms and Conditions:

1. Eligibility

Both BirthdayBot users and non-users can participate in the Program.
You only need to create an account on our referral program platform at https://birthdaybot.getrewardful.com/signup
By creating this account, you agree to comply with these Terms and Conditions.

2. How the Referral Program Works: In Brief

After registering in the program using this link you will get a unique referral link (the "Referral Link” ) to share with others.

When someone uses your Referral Link to install BirthdayBot for the first time and starts a free trial within 60 days - they become your Leads. We track it using Cookies.

When they start paying for the product, you will start earning 15% of every payment. The 15% fee applies for an unlimited amount of time as long as the referred person continues to make payments and you remain eligible for the Program.

Sales are validated once the referred user makes a successful payment that is not refunded. Payments will be processed four times a year (every quarter) via the Wise payment system.

Affiliates receive payouts if the minimum payout threshold of $20 (twenty US dollars) is met for this quarterly payout, otherwise, the funds keep accumulating.

Commissions are payable only on actual payments received from referred users, and fraudulent or refunded payments will not be eligible.

3. Definitions of Terms

Referral Link: A unique URL provided to a participant (inviting user) that tracks the referral process. When an invited user clicks the referral link and registers for BirthdayBot, the inviting user becomes eligible to earn commissions on any payments made by the invited user.
Commission: The percentage of payments made by the invited user to BirthdayBot that the inviting user earns as a reward for referring the invited user. In this program, the commission rate is 15% of every qualifying payment made by the referred workspace or user.
Invited User (Referred User): A new user or workspace that registers for BirthdayBot using a referral link provided by the inviting user. The invited user must complete a payment for the inviting user to earn commissions.
Inviting User (Program Participant): A participant in the referral program who shares their referral link with others. When an invited user registers and makes payments, the inviting user earns a commission for facilitating the referral.

4. Referral Program Guidelines

Referral Methods: You can share your Referral Link via personal communication, email, or social media platforms. However, participants may not use paid advertising, misleading tactics, or engage in spam to distribute their Referral Link. Program participants are granted a limited, non-exclusive, revocable license to use BirthdayBot branding solely to promote the referral program. Any misuse or alteration of BirthdayBot trademarks or logos is strictly prohibited without prior written consent.

Commission Payments: Referral commissions will be paid out through Wise, subject to their respective terms and conditions. Payments will be made to the account information provided in your Referral program personal account. To receive commissions, Inviting Users need to have a Wise account up and running. Refunded payments do not generate commissions. If Referral Program is deactivated by BirthdayBot, all due payouts will be executed prematurely

Commission Rates: The standard commission rate is 15% of every payment made by the referred workspace, valid for an unlimited amount of time. Special promotions may temporarily increase commission rates, which will be communicated via email or platform notifications.

Personal Accounts: You will have access to your personal referral account where you can track your referrals, commissions earned, and manage your payout information.

Referral Tracking: The tracking will be handled via the Rewardful platform. Each participant is provided with a unique referral link, and all activity tied to this link will be automatically tracked. Referrals will be considered valid only if the referred user subscribes to a BirthdayBot paid plan and completes at least one payment.

5. Prohibited Activities

The following activities are considered unfair use of the Program and are strictly prohibited:

Referring your own workspace, organization, or business for personal gain.
Creating multiple accounts to self-refer or manipulate the system.
Encouraging others to sign up using fake or temporary email addresses to gain commission.
Participating in or promoting fraudulent schemes, including generating fake referrals or using automated systems (e.g., bots or scripts) to gain referrals.
Misleading referred users about the nature of BirthdayBot or the referral rewards.
Any other activities designed to artificially inflate commissions.

Program participants must comply with all applicable local and international laws, including GDPR and CAN-SPAM Act. Program participants are prohibited from using unsolicited email, SMS, or social media spamming techniques to promote their referral link.

If any of these fraudulent actions are detected, BirthdayBot reserves the right to:

Block or deactivate your referral account.
Forfeit any unpaid commissions.
Take additional legal actions if necessary.

6. Confidentiality Clause

Program participants agree to keep confidential any and all proprietary or confidential information shared by BirthdayBot in relation to the Program. This includes, but is not limited to, referral commissions, program details, and any other privileged data.

7. Indemnification

Program participants agree to indemnify and hold BirthdayBot, its directors, employees, and agents harmless from any and all claims, damages, liabilities, and expenses (including legal fees) arising from their participation in the Program, including any breach of these Terms or violation of applicable laws.

8. Account Termination

BirthdayBot reserves the right to suspend or terminate any user’s participation in the Program if fraudulent, abusive, or suspicious activity is detected. Additionally, BirthdayBot reserves the right to modify or terminate the Program at any time, with or without notice.

9. Disclaimer of Liability

BirthdayBot is not responsible for any technical malfunctions, problems with the Rewardful platform , or payment processing delays through PayPal or Wise. Participants must ensure that all account details provided are accurate to avoid payout issues.

10. Changes to Terms

BirthdayBot reserves the right to update these Terms and Conditions at any time. Continued participation in the Program after any changes constitutes your acceptance of the new terms.
